Dr. Lillian Glass Win Against Copyright Infringer, Marsha Petrie Sue Lends Support To Photographer Dave La Chapelle in Rihanna Suit

A few months back, I won a  Copyright Infringement case two against a professional speaker from Scottsdale, Arizona, Marsha Petrie Sue, who was found liable in a US Federal Court in Los Angeles of  willful copyright infringement, by a unanimous jury of eight. Therefore,   I have a  tremendous amount of  admiration and lend my support to famed photographer Dave La Chapelle for going after singer Rihanna and her team, including her her video director  Melina Matsukas.


In my case  defendant and  Marsha Petrie Sue did word for word copying of my materials and placed it  in her 2007 “Toxic People” book,

which by the way is the same name as my 1995 “Toxic People” book. She not only used my copyrighted material in her book, she placed it on her website  and took credit for it as her own.

Appalled at seeing my very own material  in her  “Toxic People” book in addition to seeing it on her website, where she welcomed people to use my material if they wished as long as they gave her credit, I had  absolutely no recourse but to  protect my rights legally.

MY FIGHT FOR FOR EVERYONE WHO  CREATES

In fighting my legal battle, it was not   only for myself, Instead it was was everyone who shares the creative spirit. I was inspired and motivated by keeping in mind  all other  authors, screnwriters, songwriters,  artists, designers, and photographers.

Therefore , when I just discovered that the  famous and talented   photographer Dave Chapelle decided to stick up for his  legal rights I was thrilled. It showed me, how like myself there was someone else out there would would not allow anyone to take credit for what what not rightfully theirs.
Dave LaChapelle is suing singer Rihanna, her record label and  video director Melina Matsoukas, for  allegedly using his copyrighted photos as the basis for Rihanna’s most recent  video, entitled S&M. His   photos  were also apparently used without his permission or  any  reference  made to to him.
Similarly, Marsha Petrie Sue, who was also accused of plagiarism by a university professor for word for word copying of Lars Dahlgren’s work,  claimed my material as her own, She did not give me or Lars Dahlgren for that matter any  credit for our respective work. Likewise, Rihanna and her video director and record label have allegedly claimed David LaChapelle’s material as their own without giving him proper attribution or credit.

Dave La Chapelle states the  similarities between his copyrighted work and the costumes and poses used in Rihanna’s video as  he  alleges they were “willful, wanton and deliberate” acts of copyright infringement.

In my case, a unanimous jury found  that there were “willful, wanton and deliberate” acts of copyright infringement with regard to Marsha Petrie Sue.

LA Chapelle alleges Rhianna and company used his  copyrighted image “Latex”  where  in Rihanna’s video, noting a the left side of  her   face  is against a blue background as she is wearing false eyelashes and close-fitting, shiny, pink latex hood, with her mouth open as a  small candy is placed on her tongue  which was  a striking similarity to his work.

Allegedly Rihanna and her team wanted the video director to create a “LaChapelle-esque” music video. Dave  LaChapelle also found  that the storyboards which were apparently used for the video had prints of his photographs.
He said “Musicians commonly pay to sample music or use someone’s beats and there should be no difference when ‘sampling’ artist’s visuals.

He is absolutely correct!  As a writer, people have paid me to use my quizzes or the lists in my books, especially those in my “He Says She Says” book.

So when Marsha Petrie Sue claimed my material as her own she paid the ultimate  consequence of  being found liable by a unanimous jury of 8  in a US Federal court  in Los Angeles as a “willful copyright infringer”.

In the past, Dave  LaChapelle has made  millions of dollars for his videos such as the ones he directed for  Jennifer Lopez, Christina Aguilera and Britney Spears, For him it is not just about the money.

It was not about the money for me either.  In fact because Marsha  Petrie Sue didn’t sell that many books, my award wasn’t that high.

But it was the principal of the situation that meant the most to me as it no doubt is with Dave  La Chapelle.
No doubt the funds will be affected by 11  countries refusing to sell the video which they consider  offensive.
Going all the way and taking any case through the legal system until it ends up in  a US Federal Court is not simple and is not for the faint of heart. It requires a lot of mental, emotional and physical fortitude  to deal with the emotional roller coaster  that takes place. In the end, it has been my experience that  it  well worth it.

After winning my case against  Marsha Petrie Sue I have become even  more  empowered as a human being.

It has not only given me  peace of mind, but  the inner  strength  and self esteem that I will never allow anyone to take from me what is not rightfully their. I stuck up for myself and what I created and I won.

Eadh day of the three day trial I say a huge American flag standing in front of me. It moved me emotionally and it motivated me. Marsha Petrie Sue, Motivational Speaker, Found Guilty of Willful Copyright Infringement by US Federal Court, Also Accused of “Plagiarism” By Stanford University Professor

Stanford  University Robert I. Sutton accused Marsha Petrie Sue, an Arizona professional speaker of  “plagiarism” . Marsha Petrie Sue is a now known “copyright infringer” after  a unanimous jury in a  US Federal Court jury in  Los Angeles found her liable of willful  copyright infringement on December 9, 2010.

Marsha Petrie Sue unlawfully copied  Dr. Lillian Glass’ materials and  placed them  in her 2007 Toxic People book, which by the way was the same title as Dr. Glass 1995 best -selling  Toxic People book.

STANFORD PROFESSOR REPRIMANDS MARSHA PETRIE SUE ON AMAZON BLOG

The Stanford University professor openly accused Marsha Petrie Sue  of  plagiarism.

In  a  post on  Marsha Petrie Sue’s amazon blog (which has hence been removed)  which Professor Robert Sutton wrote in  2008, he tells Petrie Sue that she “took nearly word for word from an article “ that  Professor Sutton published  in the McKinsey Quarterly ,where he  provided a quote from Lars Dalgaard, CEO of one of the one of the  most successful and fastest-growing software companies. Apparently  Marsha Petrie Sue used Dalagaard’s quote without attributing it to him, thereby claiming it as her own.

Professor  Sutton is quoted as saying  “There are some words omitted, but there is no attribution to original source and note below how you have pretty much simply removed some of the words from the opening of the original article. Note that I am a professor at Stanford, and directly taking text from a source with providing any attribution fits our definition of plagiarism.”

He provides her with the original source and says to  Marsha Petrie Sue:Note the identical sentences” which you can read below as Professor Sutton  points out the specifics of  Marsha Petrie Sue’s plagiarism.

He then as concludes  his admonishment of Marsha Petrie Sue by writing” Perhaps Amazon blogs don’t need to follow the Stanford  honor code, but I would never use so much text from another source without attribution, and I think that nearly  all other universities –and authors –would agree that acknowledgment of the source is appropriate.”

Professor Sutton is correct in his statement that he believes that all authors would agree that acknowledgement of a source is appropriate.

Not attributing someone’s work to them and claiming it as their own is copyright infringement as a US Federal Court unanimous jury confirmed in a  trial against Marsha Petrie Sue where she was found liable for willful  copyright infringement.

Petrie Sue  not only wrongfully copying Dr. Glass’ materials from Dr. Glass’  1992 “He Says, She Says.” book and placed those materials in Petrie Sue’s 2007 Toxic People book,(the same name as Dr. Lillian Glass Toxic People book written in 1995)  Petrie Sue took Glass’ material and openly placed it on her website.

On  Marsha Petrie Sue’s website  she  had the audacity to give written  permission to others to freely use Dr. Glass’ work only  if they included  Petrie Sue’s website address in order to promote  Petrie Sue’s Professional Speaking business.

Dr. Lillian Glass 2010 Ten Top Favorite and Inspiring Gifts

With  Christmas over and the New Year approaching, it is time for me to look back on this year and to reflect on what were some of my best gifts. These best  gifts  are  my happiest  moments for which I am so grateful. As you will see from my list, the gifts of communication, being able to express myself, and being proactive, are some of the most important gifts for which I am grateful. Here is my list for 2010:

 1. The gift of Truth and Justice and the knowledge that  the American Justice system works as I  won a copyright infringement trial against Marsha Petrie Sue who not only copied my materials word for word but who also had the audacity to call her 2007 book Toxic People, the same name as my 1995 book Toxic People.  It was the best gift in the world to see that people like her cannot get away with this and that they must be held accountable for their actions and that everyone must know it.

2.  The next gift was  the enormous outpouring of the  public response, support  and touching comments of how I inspired so many people by going the distance and  fighting for my rights against people like Marsha Petrie Sue who take what you created and claim it as their own and how it inspired them to fight for their rights as well. The gift of their beautiful words are forever in my heart .

  3. The   powerful and healing words Eric Bjorgum,  my wonderful intellectual property attorney so  eloquently spoke in the US Federal courtroom is another gift I will carry with me forever.

 4. The gift of seeing how many people have already been impacted by reading my TOXIC MEN book is also a huge gift to me. The moving feedback of so many readers along with the support of Patti Stanger, BRAVO’s Millionaire Matchmaker, Dr. Laura,  Dr. Robi Ludwig,  and  Robin Sax, and of course  SNOOKI have meant so much to me.

 5.The gift of working with Nancy Grace and being a regular contributor  to her HLN show as well as to her Swift Justice Show. Being around Nancy  Grace, a woman with a mission who’s dedication to justice and to helping crime victims continues to inspire me.

6.  The gift of working with Adams Media and F and S Publications and  in particular the  wonderful people who have been so supportive of me and  my books and allowing me the forum to express myself so that I can get my message across to others.

 7.The gift of being able to regularly  express my thoughts and share my knowledge throughout the media from having my own body language column in Cosmopolitan Magazine to appearing  as a resident body language expert on such shows as  Millionaire Matchmaker and Dr. Phil as well as other television, radio , magazine, and internet outlets on a regular basis. I count my blessing daily.

 8. The gift of giving back is one of the things for which I am most grateful. Every week my family members and I travel around town to find those in need and provide them with a few things which can make their lives a little easier on the streets , from fresh warm blankets, to warm socks,  and tee shirts and sweats . Seeing bright eyes and smiles on faces that haven’t smiled for a long  time,  makes life worth living and is the best gift I can ever receive.

 9. The gift of new friends who seem like old friends ( ie.  Michael, Cat, Deborah,  Ree, Lois, Art, Jim, Steve,) and my old friends who have been renewed ( ie. Jan and Dave,  Reba, Martha, Elis, Chopsey, David,  Bob and  Stacy,  Susan, Shar , Ilsa, Robert, Teri, Nancy,  Donna , Jennifer,  Gloria, Rolanda, Carrie,  Mark, Bob, Phyllis, Suzy  Connie, Chris, Donna, Katiem Kerry,  Janet Victor David W, Motty, Shadoe, Brian, John, Gail)    and to FB for now allowing me to keep in touch.  I am grateful for all of my FB friends and friends on Twitter and most of all my very close and special  friends who add to the beauty of my life.

    In reporting this story,the media has  clearly sent a message that this was  a newsworthy story and  a very important message for everyone to hear. It said that copyright infringement is a serious issue. It spoke of how someone boldly stood up and fought for their rights and took that fight all the way to a United States Federal Court and won. It said that a jury unanimously agreed that Marsha Petrie Sue was a copyright infringer.

      

    A FEDERAL COURT JURY HAS SPOKEN

    The sweetest words to my ears was when the verdict was read. Below are the exact questions  which were read and the exact answers to those important questions- “YES”

      

    A SENSE OF EMPOWERMENT

     It is a very powerful and moving experience to stick up for your rights. Doing so has empowered me. I will carry that for the rest of my life. It was  a very moving experience to sit in a courtroom for three days and watch the American justice system in action.  The system works and I am living proof that it does work.

    Each day I was motivated by the beautiful large American flag that was in front of me in the courtroom. For me, it was the ultimate symbol of truth and justice and the foundation what this wonderful country is based on. Every time I looked at the flag, it gave me hope and courage.

    My intention in going to court was not about the money or to get a windfall. Instead, it was about truth and justice. I felt very strongly about it. I have worked very hard all of my life. I have made a lot of sacrifices in my life and I have never taken the easy road or the simple way out.

    So when I saw someone do word for word copying of my work without giving me proper attribution, refusing to apologize, or to make things right, I had no choice but to exercise my legal rights.

    Marsha Petrie Sue wrote a book in 2007 called ‘Toxic People.’ In that book she had wrongfully copied my material in my ‘He Says She Says’ book which I wrote in 1992.

    The jury of eight unanimously  agreed with  the fact that Petrie Sue did indeed wrongfully copy my material.

    Coincidently, I also wrote a book called ‘Toxic People’ in 1995.  One day while doing a search on Amazon.com, I stumbled across Marsha Petrie Sue’s 2007  book that had the same title as my book, ‘Toxic People.’ That is how I learned that her book contained my material from ‘He Says She Says.’ 

    Needless to say I was shocked. I have written fourteen books and they are my life’s work. My books are filled with a lot of information that have helped a lot of people. The countless phone calls, emails, and letters I have received throughout the years are testimony to that.

     If someone is interested in using some of the materials from  any of my books or blogs for that matter, I have no issue with that. But you must contact me first to get my permission. No one can simply copy my work without giving me or anyone else from whom they copy, proper credit and hope that I won’t find out.

    Marsha Petrie Sue  not only copied my material and placed it in her book, she took my copyrighted material and put it in her website and claimed it as her own. In addition, she stated on her site that she gave  people permission to use my material only if they mentioned her name and gave her credit.

    I NOT ONLY STOOD UP FOR MYSELF  I STOOD UP FOR EVERYONE WHO CREATES ANYTHING!

    I stood up to Marsha Petrie Sue and her behavior and I did it in a Federal Court. I not only stood up to her for myself, I stood up to her on behalf of anyone who creates something.

    Whether you are an author, screenwriter, songwriter, composer, sculptor, artist, illustrator, fashion designer, furniture designer, auto designer, poet, architect, photographer, jewelry designer, shoe designer, or anyone who has developed something from your own creation, you have a right to defend what is rightfully yours.   

    My  legal victory is not just for me. It is for you too. I fought on behalf of you as well. I  kept you in my heart and in my thoughts throughout this entire ordeal.

    It has now been a week since I set foot in Judge R. Gary Klausener’s courtroom and watched him sit high above on his bench in his regal black robe as he ruled on various technical legal matters.

    It has been less than a week since my fabulous intellectual property attorney Eric Bjorgum of Karish and Bjorgum articulated  so eloquently and passionately on my behalf. His wonderful words were healing and will continue to resonate within me for a lifetime.

    This was not an easy task by any means. But it was well worth it. I have come away from this experience more motivated than ever to be a voice for people. I am blessed to now be able to serve as an example to  empower others in letting them know that  they never have to feel victimized  and that they have recourse through the justice system.

    DR. LILLIAN GLASS WINS COPYRIGHT INFRINGEMENT TRIAL AGAINST MARSHA PETRIE SUE

      On December 9, 2010, a jury in Los Angeles, California unanimously found in favor of media personality Dr. Lillian Glass in her copyright infringement trial against Marsha Petrie Sue, an author and professional speaker from Arizona.

      In the trial, Dr. Glass had alleged that Petrie Sue’s 2007 book “Toxic People” had wrongfully copied from two lists in Dr. Glass’ 1992 book “He Says, She Says.”  The jury of eight agreed.  

     Dr. Glass had also written a book in 1995 called “Toxic People.”  She stumbled across Petrie Sue’s book of the same title on Amazon.com and learned that it contained material from “He Says, She Says.”

     The author of fourteen books, Dr. Glass said: “I’m so happy, so proud to live in this country where we can send a message about improper copying.  My books are my life’s work.  They are full of  valuable and helpful information. If a person wants to use something, contact me.  But don’t copy my work without giving me credit and hope I won’t find out, because I will stand up to anyone who does this.”

     “I not only fought this legal battle for  myself,” added Dr. Glass,” I fought it on behalf of  everyone who creates something.”

    Marsha Petrie Sue’s Word for Word Copying Exposed in Lawsuit Involving Book with Same Title As Dr. Lillian Glass’ Original 1995 Best Seller- Toxic People

    I often listen to my favorite radio show, National Public Radio’s (NPR) This American Life”, hosted by Ira Glass. This time, one of the show’s producer’s, Sarah Koenig, hosted the show about her brilliant 88 year old father Julian Koenig, a pioneer legend in the advertising industry.

    The show was called  “Think Small: Julian Koenig v. George Lois. ” You can click below  is you want to listen to the entire show.

    But in a nutshell,  the show  was about  Julian Koenig being ripped off  by a colleague named George Lois, who took  credit for Julian’s creative ideas like the classic Volkswagen add “Think Small” and countless others.

    George Lois even allegedly stole a personal experience that Julian Koenig had with Muhammed Ali, where Julian convinced the great boxer to pose as a pin cushion for a specific photo shoot. Apparently, George Lois wasn’t even present at the photo shoot according to Julian Koenig.

    As Julian Koening relayed these alleged  egregious acts of George Lois I could hear the pain still present  in his voice for incidents which took place over  forty years ago.

    Julian got some emotional relief by placing an ad in Adweek (which unfortunately he had to pay for) accusing George Lois of being “the greatest predator” of his work. The NPR radio show and podcast also helped him to gain back his dignity, which was made possible by the fact that his daughter Sarah Koening, is one of the show’s producers.

    TOUCHED BY JULIAN’S  STORY BECAUSE A SIMILAR THING HAPPENED TO ME

    When I heard the emotional pain in 88 year old Julian’s voice, I was deeply touched to the bone. I  shared Julian’s pain as the same thing essentially happened to me.

    The only difference is that Julian did not pursue legal channels as I am doing against a woman named Marsha Petrie Sue, a motivational speaker who did word for word copying of my work and called her book the same title as my book, TOXIC PEOPLE, which I wrote in 1995.

    She had gone around the country giving lectures called Toxic People as well.  I am now  suing her for copyright infringement in hopes that justice will be served.

    I was so deeply moved by the NPR broadcast  that I wrote Julian Koenig’s NPR producer daughter the following letter that I wanted to share with you in this blog:

    LETTER TO SARAH

    Dear Sarah

    My name is Dr. Lillian Glass ( www.drlillianglass.com). Yesterday I heard the fantastic interview you did on NPR about your brilliant 88 year old father Julien Koenig, a genius and pioneer  in the advertising world and how his partner George Lois tried to take credit for your father’s original work with regard to the creative advertising campaigns your father originated.

    I think what you have done for your father in presenting this information publicly is the biggest gift you could have given to this great man. It should be very healing for him to know that the truth has now been exposed to the world.  

    I want both you and your father to know that your father’s story touched me very deeply on a very personal level.

    After hearing the emotional pain in your father’s voice as he spoke of the despicable act of someone trying to take credit for his work and representing themselves as the creator of your father’s branding, I became even more motivated in my own fight for justice in a similar situation with an author who has done word for word copying of my book,  which she also called by the same name- Toxic People.

    Like your father, I have worked hard all of my life. In 1995 I wrote a book called Toxic People and gave lectures on the topic throughout the world. A few years ago in 2007  a Marsha Petrie Sue not only wrote a book called Toxic People but she did word for word copying of my work and has put herself out there as the author of Toxic People, causing considerable confusion in the ,marketplace I feel .   She took identical word for word copying of information in  my He Says She Says book and placed in in her version of her Toxic People book. Needless to say, I am involved in

     

    I have had my doubts about going forward, but I always return to the conclusion: how can I look myself in the mirror if I don’t at least get a court to say whether this is or is not actionable copying?

    As I venture forth in my own pursuit of justice, it will be your father’s voice that will help propel me forward. I will never forget the pain I heard in his voice as he discussed the egregious acts of George Lois.

    I will keep your voice in my mind as well as someone who exposed the injustice intellectual thievery.

    People who take credit for other’s work and do word for word copying of their materials must be exposed for the frauds they are.

    I am only sorry that your father did not pursue his grievance against Mr. Lois through the legal system in order to achieve justice and closure.

    But the fact that you have exposed this case around the world should bring your father peace of mind as he has definitely achieved  justice in the court of public opinion.

    STICKING UP FOR MY DIGNITY, SELF WORTH,AND  SELF RESPECT

    As I essentially stated in this letter to Sarah Koenig, how could I live with myself and not look myself in the mirror if I did not fight for myself and what I have worked for my entire life? What would that say about me as a human being and about my self worth and my self respect?

    I cannot allow what  happened to Julian Koenig over the past 40 years to happen to me. I cannot allow the pain about the  injustice  to fester within me for years  without resolution. As Julian Koening  used the term “intellecual predator” I too am seeking legal action against someone I feel has behaved as ab “intellectual predator” by doing word for word copying of my work- Marsha Petrie Sue.

    Let Julian Koenig’s plight be a lesson to us all. Let us not keep things in when we believe injustice has been done to us in any way. Instead, let us speak up and act immediately so it doesn’t have to fester inside of us for decades.
