WITNESS PREPARATION
How well a witness performs on the stand is critical to the outcome of your case.
Studies show that a witness’ credibility, likability, and authenticity is often judged by how well they can communicate -how they speak, their tone of voice, body language, how they behave, and how they look and dress in the courtroom.
While the trial team is essential in helping the witness prepare to testify about the details of a case, Dr. Glass’ skills can be invaluable to you in helping to enhance your client’s verbal and nonverbal communication skills so that they can successfully get their message across with clarity.
As a body language expert, voice and communication specialist, she can help your client present their best image so that they will be well perceived. They will learn how to fluidly articulate their thoughts, speak in appealing and modulated tones, and be mindful of their facial and body language as well as their attitudes while sitting at the counsel table or sitting on the witness stand .
In addition, Dr. Glass will also provide your client with trial wardrobe and grooming, hairstyle suggestions in order to achieve a more favorable impression in the courtroom. Since various colors, the fit, and style of clothing can make a psychological impact on how your client is perceived, Dr. Glass’ knowledge in this area can prove to be invaluable to your client.
Dr. Glass is not only available to help you prepare your client and witnesses for trial, she can also assist you in helping to prepare them for their videotaped deposition performance so that they can feel more confident and more in control during this often frightening and stressful experience.
Dr. Glass’ has been very successful in transforming negatively perceived witnesses, as determined via mock trials, into more likeable witnesses, thereby
creating a favorable impact on the financial outcome of the case. Perhaps the most dramatic example was when a negatively perceived client was initially awarded zero dollars during a mock trial presentation. After Dr. Glass’ witness preparation, the jury’s perception of the now “likeable” client won a $33 million dollar jury verdict. Just as Dr. Glass transformed this client, she will be able to do the same with your clients as she will tailor her skills to meet your specific needs.
JURY SELECTION ASSISTANCE
As you know, jury selection is vital to your case. While many attorneys believe they can do this on their own by trusting their own gut level instincts, oftentimes a trained professional with additional skill sets in this area may be invaluable to your team.
Dr. Glass’ expertise can be an asset in assisting you and your team in developing an effective strategy for picking a jury. She can help you make significant decisions about a prospective juror’s true belief systems and their characteristics which may influence their decisions concerning your case.
Her analytical methods can be instrumental during voir dire, whereby she can provide you with suggestions that will help you to easily identify a prospective juror’s real attitudes and life experiences which may possibly influence their judgment of your case.
The data she will collect from her pre-trial research can be a vital tool which will add to your ability to influence the make up of the impaneled final jury.
When retained to assist counsel at jury selection, Dr. Glass will observe voir dire, conference with counsel throughout the process, assist with arguments for strikes for cause, and will also suggest preemptory strikes.
JURY PROFILING
Dr. Glass will provide you with qualitative and quantitative data from case specific pre-trial research to allow you to have attitudinal characteristics, values and beliefs of the ideal and non-ideal jurors for your case.
COMMUNITY ATTITUDE SURVEY
A Community Attitude Survey provides you with the landscape of the attitudes, values, beliefs, and demographics potential juror’s in the community as it analyzes possible juror’s perceptions.
It is invaluable when you want to learn about a venue and community bias and how people respond to certain key issues in the case, including the parties involved in litigation. It can also give you insight regarding as to the effects that pre-trial publicity might have on your case, which may influence your venue.
Finally, it can also help in profiling jurors by determining how juror demographics experiences, and predispositions can affect the outcome of a verdict, thereby identifying high risk jurors. It can also identify critical questions that need to be asked on juror questionnaires and in voir dire.
MOCK TRIAL/ FOCUS GROUPS
In the Focus Groups, jurors are presented with a summary of the case as the evidence which would be presented is described. Then jurors are questions about their reactions to the case and often. asked for a verdict. In civil cases they would be asked what amount they would award in damages.
In the Mock Trial the lead counsel selects a colleague to argue for the opposing side. Then the two lawyers make their opening statements and present their evidence as they would at the actual trial and then make closing statements.
The jurors will then give written feedback about the persuasiveness, and witness testimony. Their feedback is extremely helpful in gaining insights into juror perceptions of the case, witnesses, and attorneys. It also allows you to develop a juror profile terms of finding out your ideal juror and what is the best jury selection strategy.
In addition to testing out your case to see it’s strengths and weaknesses, it gives you feedback as to the initial impressions of your opening and closing statement.
Mock jurors will also engage in mock jury deliberations where counsel will watch the juror deliberations along with Dr. Glass, thereby obtaining insight into the thinking process behind the verdict.
Dr. Glass will be able to provide you with her recommended voir dire questions to sift out those jurors who’s views do not allow them to decide the case in your favor.
Both the Focus Group and the Mock Trial will be tailored to your specific needs.
SOCIAL MEDIA ANALYSIS
By monitoring social media ( Twitter, Linked In, Facebook, Instagram, Blogs) Dr. Glass be able to discover more information about potential jurors in a jury pool, including their biases, background, views on specific topics, and personal information which could help determine whether a potential juror will side with the prosecution or the defense, prior to voir dire. This will give the attorney an added advantage in jury selection.
It can help you gain insight into a specific juror based on their behaviors, interests and on what sites they actively visit. Uncovering information about them can help in determining what you may or may not want in a juror.
Social Media analysis can be invaluable in discovering whether a potential juror is lying during the voir dire process as facts are checked using social media as one tends to be more truthful in their opinions when communicating online.
Finally, social media analysis will be monitored to determine if any juror was in violation of court orders .
JURY QUESTIONNAIRES /VOIR DIRE
Jury Questionnaires are designed to discover a potential juror’s honest attitudes, life experiences, values. They are also designed to eliminate those jurors who will not be fair to your client.
Since, the purpose of voir dire is to allow both parties an opportunity to discover whether a prospective juror can be fair and impartial without any inappropriate biases, research has determined is that potential jurors tend to be more honest on written juror questionnaires than in oral voir dire, mainly because they are fear embarrassment when verbally communicating their views.
Therefore in oral voir dire, they most likely tend to provide superficial and more socially “correct” answers rather than verbalizing what they truthfully feel. In contrast, written questionnaires, afford jurors with a degree of perceived privacy which makes them feel less self conscious or embarrassed about discussing topics, regardless of its sensitivity.
The state of the art written questioning techniques, are court sanctioned in that they allow jurors to reveal relevant information about themselves are specifically designed to help the attorney identify the attitudes, life experiences, personal values/beliefs, and demographics of prospective jurors that might influence their judgment in the case.
.Once the jury pool completes the questionnaires, their answers are analyzed, ranked and rated and suggestions for potential peremptory strikes are made along with suggestions for strikes for cause.
Since it is so important to find out which juror’s beliefs or values will prevent them from believing in your case, I can provide you with a set of voir dire questions which show jurors’ biases, values, prejudices and beliefs in order to help you eliminate unfavorable jurors.
PROFESSIONAL TRIAL OBSERVATION
Dr. Glass’ impressive body language analytical skills and her expertise in detecting deception can be invaluable to you during the courtroom trial.
Her observations and understanding of the verbal and nonverbal behaviors and actions and reactions of juries, judges, witnesses, opposing counsel and arbitrators in response to the arguments and testimony that is presented in the courtroom or in arbitration can provide you with the wining edge.
Having Dr. Glass’ presence in the courtroom can provide you with both objective and positive support and meaningful information that can make a huge difference in your case during the trial.
TRIAL MONITORING/ SHADOW JURY
Since it is not possible to speak to juries during the trial in order to find out what they are thinking a Shadow Jury may be instrumental for a case that is already in trial.
Without interfering with the actual trial, we are able to gain a great deal of insight from our Shadow Jury participants, who consist of a group of people who replicate the actual jurors and who’s job is to sit in the courtroom as a spectator , observe the trial, and provide feedback of the strengths and weaknesses of the case to Dr. Glass who then relays the information to the trial team each day so that adjustments can me made.
Their role is to discover if you are doing well with the actual jury and you are on target with the presentation of your case or if you need to present additional information so that the jurors are better able to understand your case. Thus, they are able to provide a great deal of insight into the progress and possible outcome of the case.
POST VERDICT INTERVIEWS
Post Verdict Interviews, which will be done as soon after the completion of the trial as possible. However, it is important to note that some courts prohibit or restrict Post-Verdict Juror interviews. Therefore, all care will be taken to ensure that all local and state rules are followed, and juror’s rights are respected at all times.
The Post Verdict Interviews are designed to find out why the jury made the decisions they made and what were the factors that influenced them. After the interview, you will receive a report consisting of the juror’s actual comments verbatim and their perceptions of the case, as well as my analysis of each juror.
As an accomplished interviewer, Dr. Glass’ highly developed communication skills will enable jurors to freely, honestly, and comfortably express their thoughts about the case. Thus, you will have a more accurate reading of the juror’s perceptions, how they arrived at their conclusion, which witnesses they found favorable or unfavorable, and their views of the trial teams.
The information you will receive can be invaluable to you, especially if you will be representing the same client in the future or if you are representing a similar case. It can also help you to strategize future arguments during the appeal process. In some instances, Post Verdict Interviews have identified potential juror misconduct , which the trial team may subsequently want to bring to the attention of the court.
